A former assistant attorney general says the head of the nation’s juvenile justice agency misled her into approving millions of dollars in grants to organizations that he favored. 
Regina Schofield said Thursday that J. Robert Flores, administrator of the U.S. Office of Juvenile Justice and Delinquency Prevention (OJJDP), “misrepresented the rating scores” of bidders for the National Juvenile Justice Programs last year, hiding the fact that most of his choices received lower scores than many of the proposals that he rejected. 

Schofield’s statement on Thursday could undercut a defense that Flores has given as a congressional committee investigates his agency’s grant making: that Schofield approved the grants. 

Flores declined to comment about the allegation by Schofield, whose Office of Justice Programs oversaw the OJJDP. Flores has previously said that he followed proper procedures in awarding the grants. On May 2 he traveled to Capitol Hill to discuss the investigation with members and/or staffers of the House Committee on Oversight and Government Reform, according to people familiar with the committee’s investigation. 

At issue is a memo that Flores wrote to Schofield last July, in which he explained how he chose 10 winning proposals from among more than 100 bids for the National Programs grants. The memo repeatedly uses the phrase “highest scoring” to describe his choices, even though those choices ranked behind the top bids as scored by the OJJDP staff, and in some cases below dozens of proposals that didn’t get funded. 

Here’s what explains the discrepancy: After the agency invited bids for the funds through a Request for Proposals, Flores created new criteria and categories for the grants. The incoming bids were assigned to those new categories. 

Out of the 10 winning bids, eight were the only bids assigned to certain categories – and therefore were the highest-scoring bids in those categories. (For a detailed explanation, see “A Friend at Justice.”) 

For example: Under a criterion called “School-based outreach efforts directed at preventing high-risk activity (out-of-wedlock pregnancy),” Flores’ memo says the application of the nonprofit Best Friends Foundation “has the highest score that met the criteria.” The memo does not say, as other OJJDP documents show, that Best Friends was the only qualified bidder in that category, or that among all the bidders, it ranked 51st. 

Another criterion was “mentoring outreach efforts directed at Latino at-risk youth.” The memo names three winning bids, saying they scored the highest, second-highest and third-highest among bids “that met the criteria.” The memo does not say, as other OJJDP documents show, that those were the only three qualified bids under that criterion, or that overall, those three applications ranked 24th, 41st and 42nd. 

Schofield recently said she didn’t know that when she signed off on Flores’ recommendations last year. 

Schofield said via e-mail Thursday that her staff at the Office of Justice Programs “spent months working on a transparent process” for awarding discretionary grants, “and Flores’ memo was not true to the process agreed upon by the leadership of U.S. DOJ [Department of Justice] and misrepresented the rating scores of the recommended grantees.” 

Another point of contention is Flores’ statement in his memo that all the grants were chosen “from the top 20%.” Most of the winners did not rank in the top one-fifth of the bidders. 

OJJDP did not respond to a request to explain that discrepancy. It appears that Flores might have used the phrase to mean that his chosen bids scored within the top 20 percentage points of the scoring range – that is, from 80 percent to 100 percent. 

Schofield, now director of public policy at Casey Family Programs, said she’s never heard “top 20 percent” used that way. 

Time appears to have been a factor in how the grants were awarded. Because of a temporary suspension in congressional earmarks under OJJDP, fiscal 2007 was the first time in years that the agency had significant amounts of grant money available for competitive bidding. Many Justice Department grants were awarded under heavy deadline pressure and efforts by various administrators to award discretionary money to favored organizations. 

Schofield’s statement noted that “because of the unique budget cycle in FY 2007, we were under an intense deadline to get grants processed and awarded.”</description>

					<description>I've been sleeping with my eyes open for my entire life and just recently my roommates in college (I'm a freshman) found out too. Well they thought I was dead apparently and checked to see if I was breathing. It was more than embarassing to wake up the next morning (this morning actually) and have them tell me that I scared the living shit out of them. So I went online and am trying to figure out: 1. why I do it and 2. how I can stop doing it. If anyone has any answer for me it would be greatly appreciated. For now though I'm off to buy one of those eye masks for when I'm sleeping. 

P.S. I'm not sensitive to light at all.</description>

					<description>Well, I just woke up and sleeping with me eyes open just started about three years ago after I hurt myself right on my eyebrow. My best friend slept over my house about two years ago and started shaking me becuase she thought I was awake seeing my eyes were half open. I did sleep with my eyes open last summer and during the winter I was fine. Nothing. I didn't sleep with my eyes open for an odd reason. 
Can you find me a reasonable explanation?
I read that sleeping with your eyes open in hereditary or an injury to the area of your eyes. Seeing that I am waking up with teary eyes now I am curious about the time zones thing.
I figure that there must be something to it about remembering and such seeing that my injury to my eyebrow happened about this time of the year if I remember right. I guess the only explanation I can provide for myself is that my brain thinks that there is something wrong and is afraid that it will happen again. Remember, I only started sleeping with my eyes open two days ago but it has been happening for years.</description>

I am due for my yearly bloodwork but am going to wait until after I get my dose of the Antidote. If my elevated level also shows to go back to normal, this will be a good  test.</description>

					<description>Hello everyone who may still be reading this blog - I see that the majority of entries are from a year and 1/2 ago.  I just have to share with you my experience.  I have several quite serious and debilitating health conditions which are chronic.  Throughout the years I have had numerous tests, treatments, scans, doctors, etc.  I am in my 30's and otherwise healthy.  I live with disabling body-wide pain and daily headaches - of various natures.  However, no one has been able to successfully treat me or get to the root of my pain. I am sustained mostly by pain relievers, therapy, prayer and sheer determination. One doctor who truly wanted to help find answers, ran detailed scans and discovered a rare infection in my sphenoid sinus at the base of the brain.   I was informed that this infection was quite serious and left untreated would likely lead to meningitis which could possibly be fatal.  I needed surgery.  The surgery itself was also dangerous. The location is in close proximity to the brain, optic nerve and carotid artery.  With a risk of blindness, brain damage, or fatal hemorrhage, I was determined to find the best surgeon in the business, which I did, in Boston.  I had this surgery in October of 2004.  I came through it without incident, but it was unsuccessful in relieving the infection.  Due to its retention and my continued symptoms, follow-up scans were performed many weeks later – still no change.  I was told I would need to have this surgery repeated, once I had healed and could arrange to do it again.  Approximately a year later, I was in the prep stages for the second surgery.  With numerous obstacles along the way, I eventually had a surgery date scheduled for the first week of January 2006.  A month prior to this, I was researching – as I often do – and came across the crocodillin info.  The research seemed plausible, but the marketing of The Antidote by some unknown website seemed clearly a scam.  I read further and red flags really went up when I read customer experiences, yet saw that there was no contact info if someone wanted to contribute.  This was obvious to me that it wasn’t for real.  But I was so intrigued by the concept and do believe that there may indeed be a protein peptide that could be utilized for medicinal purposes.  And for the skeptics that say, why wouldn’t the Pharms be all over it?  They absolutely will if it is real, in the right time.  They are all about money and making people healthy is in no way the top priority of these companies, their stockholders or the government (such as FDA) – they do not have our best interest at heart – but more their own pocketbooks.  I am not a cynic, just a realist.  As much as we all would like to believe there is a philanthropic nature to those in these positions of power, the almighty dollar is much more powerful.  So, now having that in mind, I do not think much of FDA regulations or approvals – in fact, they have many times approved things, made millions, then rescinded due to problems…I do not put my trust in them.  We have to use our common sense.  And hope that if we read enough, talk enough, share enough, that the truth will eventually win out.   So before there was a cure for things which we now treat with medicines, someone found or discovered something that was at the heart of it – and it worked – that eventually led to the medicines the patents, the competitions…I would like to believe that there is some truth to the crocodillin research.  However, the Antidote marketers, just gave me no reason to put my trust in them.  HOWEVER, here is the interesting part….I decided I would try it anyway.  I felt foolish, but I was facing something really serious and nothing else was working.  It was not expensive – so what did I really have to lose?  I ordered one vial and took it as directed.  I did not tell anyone.  This was mid December just before the hectic holiday season – where I go out of town with my kids to visit my family miles away.  I thought to myself, it says it will work in between 2 and 14 days.  OK.  That takes me to the end of the year, and one week before my surgery.  If by some miracle, my scans in January (06) show that my sphenoid is completely clear, then I will know it worked.  And so I took it.  After taking it, I got so wrapped up in the business of everything, it was not even on my mind.  About a week later, while on my trip, my two children became sick with what appeared to me to be strep throat combined with ear infections.  As I nurtured them, I knew I could easily get sick myself.  Sure enough, I did.  I felt awful.  I was coughing up stuff night and day (by the way, prior to this, any coughs or congestions were completely dry – no drainage whatsoever).  Still, my focus was on getting my kids well and then thinking about how I needed to be well for my surgery.  We spent the last day of our trip traveling from one clinic to another, to no avail.  Between the busy waiting rooms and the insurance issues, we wasted the entire day and were no better off.  We had a plane to catch.  That evening on the plane, my kids screamed and cried as their ears were hurting terribly.  We all felt horrible.  When we arrived home that night – we went straight to the ER about 2am.  Both of my kids had ear infections; one was tested for strep and did indeed have that as well.  I was not tested.  Due to the infectious nature of strep, we were all 3 given a round of antibiotics.  The next week I focused on my job and getting well for my surgery.  When I arrived in NY (by this time my surgeon had moved) I had to have Brain Lab scans prior to surgery.  I then met with the doctor in his office.  He was stunned.  He said he could not explain it.  He showed me the scans – the sphenoid was entirely clear!!!  At that moment, I was so shocked, I still was not even thinking about the Antidote.  I did first think about all of my friends and family who had been praying for me – and offered thanks to God.  Now, I absolutely give the credit to God first.  However, I couldn’t help but wonder if somehow this product played a role.  Considering the timing of me being sick two weeks prior – and all of the drainage that came out of nowhere…it made sense  - but I still did not know what to think.  I chalked it up to a mystery.  I am no more convinced my cure was or was not due to this product.  I did however decide to purchase it a second time a few months later.  This time, it was for another condition I developed – which flares periodically.  I had a flare-up in March, then April, then May – at which time I took the second dose.  I did not have another flare up after that – coincidental?  Maybe.  Eventually, just a couple months ago, I began to get quite sick again – in many ways.
